How to clear or seal your criminal record in Idaho and why it matters for your recovery
A criminal record can make it harder to find housing, get a job, or rent an apartment — all things that matter for a strong recovery. Idaho law allows certain records to be sealed or expunged under specific conditions. This guide explains the basic process and where to get help.
Who Can Qualify
Idaho does not have a single, simple “expungement” process like some states. Instead, relief depends on the type of case:
- Arrests without conviction — records of arrest that did not lead to a conviction may be eligible for expungement
- Juvenile records — juvenile court records may be sealed once you meet age and waiting period requirements
- Withheld judgment cases — if you successfully completed probation under a withheld judgment, you may be able to petition to have the case dismissed
- Certain misdemeanors and felonies — some records may qualify for a motion to seal, depending on the offense and time passed
Not all convictions are eligible, and violent or sexual offenses are generally excluded. An attorney or legal aid organization can tell you exactly where your case stands.

Option 2: File a Motion Yourself (Pro Se)
FOR SIMPLE CASES
Idaho courts provide self-help forms for people who want to file their own motion to seal or expunge a record without hiring an attorney. File the motion with the court in the county where you were convicted — for Nampa/Caldwell residents, that is generally the Canyon County Courthouse in Caldwell. Fee waivers may be available if you qualify.

- Any court paperwork, citations, or case numbers you still have
- Government-issued photo ID
- Proof of income (for legal aid eligibility or fee waivers)
- A list of counties where you were charged or convicted, if more than one
What Happens After You File
The court will review your petition, and in some cases schedule a hearing. If granted, the record is sealed or dismissed according to the judge’s order. Processing time varies by county and case load, so it’s smart to follow up periodically.
